Zero Tolerance Policy

Thank you for your interest in Kite Assistant (“KA,” “we,” “us,” or “our”). At Kite Assistant, our goal is to connect people by simplifying everyday tasks and fostering community engagement through the web (collectively, the “Services”).

Kite Assistant prioritizes the safety of the communities it serves. This Zero Tolerance Policy (the “Policy”) outlines specific services or activities that are strictly prohibited while using our Services.

In addition to this Policy, your use of the Services is governed by our Terms of Service (“Terms of Service”) and Privacy Policy (“Privacy Policy”). These documents may be updated periodically, and by continuing to use the Services, you acknowledge and accept any changes made.

Key Definitions.

  • Subscription Payments, Service Payments, Subscription/Service Payments, Subscription or Service Payments, Subscription and Service Payments – These terms, or any reasonable variation of them, refer to the fixed monthly payment for Virtual talent services provided by Kite Assistant.
  • Legitimate Subscription Payments are invoiced through our financial services partner, Stripe, and are linked to a recurring monthly subscription.
  • In case of any dispute, Kite Assistant reserves the right to determine which payments qualify as Subscription Payments.

To access and use the Services, you must agree to this Policy. The term “including” in this document should be understood as “including but not limited to.” By accessing, downloading, installing, or using the Services, you confirm that you have read, understood, and agreed to the terms outlined in this Policy.

1. What Are Zero Tolerance Services?

Our platform connects individuals seeking to complete tasks with independent contractors, contracted companies, and businesses (“Fulfillers”) who are qualified to perform these jobs. While we strive to offer users a diverse range of service options and provide fulfillers with ample opportunities, certain services are strictly prohibited on our platform for legal and/or ethical reasons. These prohibited services are referred to as “Zero Tolerance Services.”

We ensure that our policies regarding Zero Tolerance Services are not made with any intent to discriminate based on race, ethnicity, national origin, religion, sex, gender identity, physical or mental disability, medical condition, marital status, age, or sexual orientation.

2. Zero Tolerance Service Categories.

Kite Assistant strictly prohibits certain services under all circumstances. These include, but are not limited to:

a.      Prostitution.

Kite Assistant does not allow any form of prostitution or exchange of compensation for romantic or sexual contact. This includes:

Compensated Dating – Paying a Fulfiller to act as a date or romantic partner for any purpose.

Payment for Sexual Acts – Paying a Fulfiller for sexual activities, including requests to dress provocatively or engage in any form of sexual contact.

Unlicensed Massage Services – Requesting massage services from an unlicensed or uncertified provider.

Vague Requests for Sexual Acts – Any request for sexual services disguised as something ambiguous.

b.      Pornography.

Kite Assistant does not permit the creation, facilitation, or involvement in pornographic content, including:

Active Participation – Paying a Fulfiller to engage in sexual acts for the purpose of producing explicit content.

Indirect Involvement – Paying a Fulfiller for non-sexual tasks that contribute to the production of pornographic content, such as operating a camera or editing footage.

c.       Illegal Drugs.

Kite Assistant strictly prohibits the illegal ordering, delivery, acquisition, solicitation, purchase, or manufacturing of any substances classified under the Controlled Substances Act (21 U.S.C. ch. 13 § 801 et seq.).

d.      Staged Kidnappings.

Kite Assistant does not allow any form of staged kidnapping, even with the consent of the recipient.

e.      Property Damage.

Kite Assistant strictly forbids paying a Fulfiller to cause damage to personal or real property.

f.        Assault, Harassment, and Violence.

Kite Assistant does not permit any form of assault, harassment, or violence, regardless of whether the recipient consents. This includes:

Verbal Assault – Paying a Fulfiller to verbally attack someone.

Physical Assault – Paying a Fulfiller to physically harm someone.

Sexual Assault – Paying a Fulfiller to engage in any form of non-consensual sexual contact.

Harassment – Paying a Fulfiller to intimidate, threaten, or harass anyone.

g.      Facilitation of Prohibited Activities.

Users cannot request individual services that, when combined, contribute to a prohibited activity. For example, hiring separate fulfillers for tasks like operating a camera and a microphone to produce explicit content is not allowed. Kite Assistant’s monitoring systems actively detect and flag such requests, and violations may lead to account deactivation.

h.      Distasteful Acts.

In addition to the acts explicitly prohibited above, Kite Assistant strictly forbids any form of Distasteful Acts, regardless of whether the recipient is yourself or if they are aware, consenting, or accepting. Kite Assistant reserves the sole discretion to determine what qualifies as a Distasteful Act under this policy.

Final Determination: Kite Assistant has the exclusive authority to decide what constitutes a Distasteful Act. Acts that are merely distasteful or both distasteful and unsolicited are strictly prohibited. However, unsolicited actions that a reasonable person would expect to be welcomed or harmless—such as sending flowers to a significant other—are permitted.

For any unsolicited act to be allowed, it must be considered harmless, as defined by Kite Assistant on a case-by-case basis. Additionally, any request for services involving a spouse, significant other, friend, colleague, or family member must be linked to or identifiable through the User’s Kite Assistant account.

3. Business Ventures and Investments.

Kite Assistant strictly prohibits the folloKite Assistant activities under all circumstances:

  1. Direct Financial Transactions – Any direct payments, transfers, or financial dealings between Users and Fulfillers, Assistants, Contracted Companies, or any Kite Assistant employee, contractor, or agent outside of legitimate Subscription Payments.
  2. Business Partnerships – The creation of business ventures, partnerships, or investment agreements between Users and Fulfillers, Assistants, Contracted Companies, or any Kite Assistant employee, contractor, or agent.
  3. External Projects – Engaging Fulfillers, Assistants, Contracted Companies, or any Kite Assistant employee, contractor, or agent in business projects, ventures, or investments.
  4. Solicitation – Soliciting or accepting business proposals, investment opportunities, or venture partnerships from Fulfillers, Assistants, Contracted Companies, or any Kite Assistant employee, contractor, or agent.
  5. Alternative Payment Arrangements – Any form of compensation outside of Kite Assistant’s authorized Subscription Payment system for services rendered by Fulfillers, Assistants, Contracted Companies, or any Kite Assistant employee, contractor, or agent.

Enforcement & Liability: Any attempt to engage in these prohibited activities will result in immediate account termination. Kite Assistant disclaims any responsibility for losses or damages resulting from Users participating in unauthorized business ventures or investments with any Kite Assistant-affiliated personnel. Any personal, financial, or investment engagement you enter into with a Fulfiller, Assistant, Contracted Company, employee, contractor, or agent of Kite Assistant—or any person introduced through the platform—is done at your own risk, with no liability or involvement from Kite Assistant.

4. Termination of Use for Policy Violations.

Any attempt—whether intentional or unintentional—to request a Zero Tolerance Service will result in the immediate termination of your account. If necessary, the incident may also be reported to the appropriate authorities. However, Kite Assistant remains committed to user privacy and will vigorously defend against legal challenges seeking access to user data whenever possible.

Similarly, any attempt to provide, execute, or facilitate a Zero Tolerance Service will lead to the immediate termination of the responsible Fulfiller’s account. If required, the incident will be reported to the relevant authorities. Reactivation of a terminated account involves a thorough internal investigation. 5. Supporting a Safe Community.

At Kite Assistant, we take pride in being responsible and ethical members of our communities. We ask that users refrain from requesting any Zero Tolerance Services to help maintain a safe and trustworthy environment.

6. Prohibited Activities.

By using Kite Assistant’s Services, you agree not to:

  • Impersonate any individual or entity.
  • Stalk, threaten, or harass anyone, or unlawfully carry a weapon.
  • Violate any federal, state, local, or international laws, regulations, or judicial decisions.
  • Interfere with, disrupt, or harm the Services, networks, or related systems.
  • Post or transmit content that is false, misleading, defamatory, obscene, offensive, sexually explicit, threatening, or otherwise unlawful.
  • Infringe upon any third-party rights, including copyrights, patents, trademarks, trade secrets, or privacy rights.
  • Distribute or transmit malicious code, viruses, or any software that could damage, disable, or compromise systems or personal data.
  • “Frame” or “mirror” any part of the Services without written permission, or use meta tags to redirect users.
  • Modify, reverse-engineer, decipher, decompile, or disassemble any aspect of the Services.
  • Rent, sell, lease, license, or sublicense access to the Services.
  • Use bots, crawlers, or automated tools to scrape, index, or manipulate the Services.
  • Transfer or sell your User, Fulfiller, or partner account or credentials.
  • Engage in discrimination or harassment based on race, ethnicity, nationality, religion, gender, gender identity, disability, medical condition, marital status, age, or sexual orientation.
